Terms of sale

These terms apply to purchases in the Nanoman Iceland web shop at nanoman.ser.is. The seller is Sér Tækni ehf. Consumer terms come first, followed by separate terms for businesses.

Sér Tækni ehf. is the seller of every product in the web shop. The products are made by Nanotech Products Pty Ltd, Australia.

Scope

These terms apply to purchases by consumers in the web shop. A consumer is an individual buying outside their trade or business.

The Consumer Contracts Act No. 16/2016 and the Consumer Sales Act No. 48/2003 also apply. Nothing in these terms limits a consumer's statutory rights.

Purchases by businesses are covered by the separate terms at the bottom of this page.

Orders and contract

A contract is formed when payment has been confirmed and we have sent an order confirmation by email.

The contract is made in Icelandic or English. We store the order and you receive a summary by email and on the receipt page.

If a product turns out to be out of stock, we may cancel the order. If a price is obviously wrong, for example because of a typing error, we may cancel the order before we have confirmed it. In either case we will tell you straight away and refund you in full.

Prices

All prices in the web shop are in Icelandic krónur and include 24% VAT. Shipping depends on the delivery method and is shown at checkout before you pay.

Prices may change. An order is processed at the price that applied when it was placed.

Payment

Payment is by card on Straumur's secure payment page. Card details never pass through our website and we do not store them.

An order is not processed until payment has been received. Businesses with an invoice account can pay by invoice; see the business section.

Delivery

You can choose from the following delivery methods. Checkout shows which ones are available for your order and what they cost. We deliver within Iceland only.

Dropp: Delivered to a Dropp pickup point, or to your door in the areas Dropp serves.
Pósturinn: Delivered to a parcel box (póstbox or pakkaport) or to your door.
Collect at Síðumúli 1: Collect from Sér Tækni ehf., Síðumúli 1, 108 Reykjavík. We will email you when the order is ready and tell you when it can be collected.

Risk in the goods passes to you when you, or someone you have nominated, take delivery.

Delivery times

Orders are normally processed within one to three working days of payment. The carrier's delivery time is added to that and depends on the delivery method and destination. Products that are not in stock may take longer, and we will let you know.

Unless otherwise agreed, we deliver without undue delay and no later than 30 days after the contract was formed. If delivery is delayed we will let you know, and you may then cancel the purchase and receive a full refund.

Right of withdrawal

Under the Consumer Contracts Act No. 16/2016, a consumer may withdraw from a web shop purchase within 14 days without giving a reason. The period starts on the day you, or someone you have nominated, receive the goods.

To withdraw, send us a clear statement before the period ends, for example an email to info@ser.is. Please include your order number.

Return the goods without undue delay and no later than 14 days after you told us you were withdrawing. You bear the direct cost of returning the goods.

We refund everything you paid for the purchase, including delivery, without undue delay and no later than 14 days after we received your notice. If you chose a more expensive delivery method than the cheapest standard method we offer, we do not refund the difference. Refunds use the same payment method you used. We may withhold the refund until we have received the goods or you have shown that they were sent.

You are liable for any reduction in value resulting from handling beyond what is needed to establish the nature, characteristics and functioning of the goods.

Exceptions

The right of withdrawal does not apply, among other things, to:

sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed after delivery;
goods made to the consumer's specifications or clearly personalised;
goods liable to deteriorate or expire rapidly;
goods that after delivery have been inseparably mixed with other items.

Returns

You may open the goods to inspect them as you would in a shop. If they have been used beyond that, we may deduct the loss in value from the refund. Please contact info@ser.is before sending anything back so that we can receive it.

In addition to the statutory right of withdrawal, unused goods in their unopened original packaging may be returned within 30 days of delivery for store credit. The credit note is based on the purchase price and is valid for four years. You pay the cost of returning the goods.

Defects and complaints

Defects are governed by the Consumer Sales Act No. 48/2003. If a product is defective you may demand repair, replacement, a price reduction or cancellation and, where applicable, damages.

Notify us of a defect within a reasonable time after you discovered it. Notice given within two months is always considered timely. The complaint period is two years from the day you received the goods, and five years for goods meant to last substantially longer than usual, such as charging stations and chargers.

A product is not defective merely because it does not achieve the desired result if it was not used according to the manufacturer's instructions or was applied to a surface it is not intended for.

Product safety

Read the product's safety data sheet (SDS) and technical data sheet (TDS) before use and follow the instructions on the packaging. The documents are open to everyone on the product pages.

Some products are classified as dangerous goods for transport, for example flammable liquids. They are not sent with Dropp but with Pósturinn or collected at Síðumúli 1, and checkout offers only those methods. If a carrier cannot accept the shipment we will contact you to find another solution.

Personal data

Personal data is handled according to our privacy policy.

Governing law and disputes

These terms and purchases in the web shop are governed by Icelandic law.

If a dispute arises we will first try to resolve it by agreement. A consumer may also refer the matter to the Icelandic Complaints Committee on Goods and Services (Kærunefnd vöru- og þjónustukaupa, kvth.is).

Jurisdiction in consumer cases follows the Civil Procedure Act No. 91/1991.

Proceedings by businesses arising from a purchase may be brought before the Reykjavík District Court.

Changes to these terms

We may change these terms. Each purchase is governed by the terms published when the order was placed.

Business terms (B2B)

This section applies to purchases by businesses and other legal entities, whether made in the business portal, through a quote or in the web shop. Such purchases are governed by the Sale of Goods Act No. 50/2000 rather than consumer legislation, and the right of withdrawal does not apply. In all other respects the general terms above apply.

Prices: Business prices exclude VAT and follow the company's price tier. VAT is added on the invoice.
Invoice account: Businesses approved for an invoice account can order against invoice. Payment is due 15 days after the invoice date unless otherwise agreed in writing.
Late payment interest: If an invoice is not paid by the due date, penalty interest (dráttarvextir) accrues under the Interest and Indexation Act No. 38/2001 from the due date until payment.
Retention of title: Goods sold remain the property of Sér Tækni ehf. until paid for in full.
Quotes: A quote is valid until the date stated on it. A quote becomes a contract when the customer accepts it within its validity period.
Quote-only products: Some products are sold only by quote and cannot be bought in the web shop. Their price and delivery follow the quote.
Graffiti Remover: Graffiti Remover is a system product intended for surfaces protected with Nanoman anti-graffiti coating. Sér Tækni ehf. is not liable for damage caused by using it on a surface without such protection.
Delivery: In addition to the web shop's delivery methods, Sér Tækni ehf. can deliver to businesses itself by arrangement.
Defects: A business must inspect goods on receipt and report defects without undue delay.
Collection: If an invoice is not paid by the due date, Sér Tækni ehf. may pass it to debt collection, and collection costs under the Debt Collection Act No. 95/2008 are added.
Limitation of liability: Sér Tækni ehf. is not liable for indirect loss, such as business interruption, loss of profit or damage to property other than the goods sold, unless caused intentionally or by gross negligence. Otherwise liability is limited to the purchase price of the goods.
Minimum order: There is no minimum order value.
